Terms of Service

Effective: April 9, 2026

1. What you're agreeing to

These terms govern your use of Boom (boom.surf), operated by Kenny Grant. By creating an account or using the service, you agree to these terms. If you don't agree, don't use Boom. Simple as that.

2. What Boom is

Boom is a micro-publishing platform. You upload content (videos, images, text, links), we give you a branded page with a URL. Viewers can react, vote in polls, and leave comments. You get view tracking and analytics. That's the product.

3. Your account

You need an account to create booms. You can sign up with Google or a magic link sent to your email. You're responsible for keeping your account secure. One person per account. Don't share your credentials. If you suspect unauthorized access, email kenny@kenny.is immediately.

4. Your content

You own everything you upload. Boom doesn't claim any intellectual property rights over your content. By uploading, you grant us a limited license to host, display, and distribute your content through the service — that's it. We need this to make the product work. We won't sell your content, use it for training, or do anything weird with it.

You're responsible for the content you upload. Don't upload anything illegal, infringing, abusive, or harmful. We reserve the right to remove content that violates these terms or applicable law.

5. Acceptable use

Use Boom for its intended purpose: sharing content and collecting feedback. Don't use it to distribute malware, send spam, harass people, host illegal content, attempt to access other users' data, reverse-engineer the service, or abuse rate limits. Don't do anything that would make us regret building this.

6. Plans and payment

Boom offers a free tier and a paid Creator plan. The free tier includes up to 5 booms and 1GB of storage. The Creator plan is billed monthly or yearly through Stripe.

If your payment fails, you have a 7-day grace period to update your payment method. After that, your account downgrades to the free tier. We never delete your existing booms on downgrade — you just can't create new ones until you're within the free tier limits or re-upgrade.

You can cancel anytime. Cancellation takes effect at the end of your current billing period. No refunds for partial periods — you keep access until the period ends.

7. Storage and limits

File uploads are stored on Cloudflare R2. Storage limits are enforced per plan. We reserve the right to remove files that exceed your plan's storage limit after reasonable notice. Individual file uploads are capped at 2GB. We don't transcode or modify your uploaded files.

8. API access

API access is available on the Creator plan. API keys are scoped to your workspace. You're responsible for keeping your API keys secure. Don't exceed rate limits (300 requests/minute for authenticated endpoints). We may throttle or suspend access if you abuse the API.

9. Availability and uptime

We try to keep Boom available at all times, but we don't guarantee 100% uptime. The service runs on Cloudflare's infrastructure. We may take the service down temporarily for maintenance. We'll try to give notice when possible, but sometimes things break unexpectedly. We're not liable for downtime or data loss.

10. Termination

You can delete your account at any time. When you do, we'll delete your data, including all booms and uploaded files. This is permanent and irreversible.

We can suspend or terminate your account if you violate these terms. We'll try to give you notice, but we reserve the right to act immediately if the violation is severe (illegal content, abuse, security threats).

11. Limitation of liability

Boom is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Kenny Grant and Boom are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the service. Our total liability is limited to the amount you've paid us in the 12 months preceding the claim.

12. Changes to these terms

We may update these terms. When we do, we'll update the effective date at the top. If the changes are material, we'll notify you by email. Continued use of Boom after changes take effect means you accept the new terms.
